There are two notable lawsuits involving Smart Water.
Smart Water Marketing Lawsuit
In 2019, a class action lawsuit was filed against Smart Water alleging that the company’s marketing was deceptive. The lawsuit alleged that Smart Water’s marketing claims, such as “vapor distilled water with electrolytes,” were misleading and that the product was no different than other bottled water brands.
The plaintiffs in the lawsuit sought damages for consumers who purchased Smart Water based on the allegedly deceptive marketing claims.
The lawsuit was settled in 2020 for $19.5 million. Smart Water did not admit any wrongdoing but agreed to change its marketing practices.
Smart Water Contamination Lawsuit
In 2022, a lawsuit was filed against Smart Water alleging that the product was contaminated with benzene. Benzene is a known carcinogen and can cause a variety of health problems, including leukemia and lymphoma.
The lawsuit alleged that the benzene contamination was caused by the use of a faulty filtration system at Smart Water’s bottling plant in Pennsylvania.
The lawsuit is still ongoing. Smart Water has denied the allegations and has said that its products are safe.
